Torq Money User Agreement

TORQ PARA VIRTUAL POINTS AND LOYALTY PROGRAM TERMS OF USE

1. PARTIES

This Torq Para Virtual Points and Loyalty Program Agreement ("Agreement") is entered into between Torq Nutrition (As Kare Sağlık Ürünleri Pazarlama Danışmanlık Yazılım Hizmetleri Sanayi ve Dış Ticaret A.Ş.), located at Ferhatpaşa Mah. 6. Sok. No: 23-25 34888 Ataşehir / Istanbul, and the Torq Nutrition member ("User").

This Agreement shall enter into force upon the User creating a membership and making purchases via the website torqnutrition.com.tr, and the User hereby accepts, declares, and undertakes to be bound by the terms and conditions set forth herein and in its annexes.

Torq Nutrition and the User shall be individually referred to as a "Party" and collectively as the "Parties".

Torq Nutrition reserves the right to amend this Agreement at any time. Amendments shall enter into force upon publication on the website.

2. DEFINITIONS

Account: The personal account created by the User within the Torq Nutrition membership system via torqnutrition.com.tr.

User: Any natural or legal person who becomes a member of Torq Nutrition and makes purchases via torqnutrition.com.tr.

Legislation: Applicable laws and secondary regulations enacted pursuant thereto.

Torq Para: Virtual points earned by Users through purchases within the loyalty program organized by Torq Nutrition, which have no cash equivalent and can only be used on torqnutrition.com.tr.

Torq Nutrition: The service provider As Kare Sağlık Ürünleri Pazarlama Danışmanlık Yazılım Hizmetleri Sanayi ve Dış Ticaret A.Ş., headquartered at Ferhatpaşa Mah. 6. Sok. No: 23-25 34888 Ataşehir / İstanbul.

3. SUBJECT AND SCOPE OF THE AGREEMENT

This Agreement regulates the principles regarding the earning, use, validity conditions, refund situations, and the rights and obligations of the Parties related to Torq Para.

4. REGISTRATION AND USAGE CONDITIONS

Any User who creates a membership via torqnutrition.com.tr is automatically enrolled in the Torq Para system. Torq Para is defined only within the User’s own account; it cannot be transferred, sold, or converted into cash, and can only be used for purchases made via torqnutrition.com.tr. Torq Nutrition reserves the right to make any changes to this application and/or to terminate the Torq Para system.

5. INFORMATION TO BE PROVIDED BY THE USER

Torq Nutrition may access the information required for participation in the Torq Para loyalty program, which shall be provided by the User.

The User accepts, declares, and undertakes that all personal data transmitted to Torq Nutrition through online channels are collected by Torq Nutrition, in whole or in part, by automated or non-automated means, in accordance with Articles 1 and 2 of the Personal Data Protection Law (“KVKK”), and that such personal data will be processed solely for the purposes of this Agreement and within the scope of explicit consent under Articles 5 and 6 of KVKK, will not be transferred to or shared with third parties, and that all necessary technical and administrative measures will be taken.

6. PROVISIONS REGARDING EARNING AND USING TORQ PARA

The User earns Torq Para at a rate of 1% of the completed purchase amount. Torq Nutrition reserves the right to change earning rates, campaign conditions, and calculation methods at any time. Torq Para earned from returned orders will be deducted from the User’s account.

Torq Para points may be combined with current campaigns and coupon codes and can be used within the validity period determined by Torq Nutrition. Points not used within the specified period shall become invalid.

Torq Para can only be used as a discount tool for the purchase of goods and services via torqnutrition.com.tr and does not substitute for cash or electronic money.

7. NOTIFICATIONS AND TRACKING

Information regarding the amount of Torq Para earned by the User is sent via email after the completion of the transaction. The User can track their balance on the “My Torq Para Account” page on torqnutrition.com.tr.

8. COMPLAINTS AND RESOLUTION

The User may submit complaints regarding the services provided by Torq Nutrition via email to info@torqnutrition.com or by contacting the Call Center at +90 (850) 290 4562. Torq Nutrition shall review such complaints and respond within a maximum of 20 (twenty) days.

9. RIGHTS AND OBLIGATIONS

The User agrees, declares, and undertakes to use Torq Para in accordance with this Agreement, not to allow others to use their account, and not to sell or share their Torq Para with third parties.

Torq Nutrition reserves the right to set limits, change usage conditions, or terminate the program. In case of misuse by the User, Torq Nutrition reserves the right to suspend and/or terminate the User’s account.

10. INTELLECTUAL PROPERTY RIGHTS

"torqnutrition.com.tr", "Torq Nutrition", "Torq Para", and all related URLs, logos, and trademarks are the property of Torq Nutrition and its licensors. The User may not copy, imitate, or use them without prior written consent.

All page headers, custom graphics, button icons, and texts are service marks, trademarks, and/or trade dress of Torq Nutrition and may not be used without permission.

All rights, titles, and interests related to the content on torqnutrition.com.tr, including any derived technologies, belong exclusively to Torq Nutrition.

11. TERMINATION

This Agreement enters into force upon acceptance by the User as stated in Article 1 and shall remain in effect unless terminated as specified herein.

The User may terminate their membership at any time.

Torq Nutrition reserves the right to terminate the program at any time. In the event of termination, all Torq Para balances in User accounts shall become invalid.
